The acting registrar of the Corporate Affairs Commission, CAC, Azuka Azinge on Wednesday shunned the invitation by the Code of Conduct Tribunal sitting in Jabi, Abuja over11-count charges bordering on non-declaration of assets and other related offences.
Recall that the CCT, through its Head of Press and Public Relations unit, Ibraheem Al-Hassan, had disclosed that Mrs Azinge was to be arraigned today, November 18, over offences that violated the provisions of Paragraph 1, 9 and 11 (1) (a), (2), of the Fifth Schedule, Part1 and is punishable under paragraph 18 (1) and (2) of the constitution.
However, during today’s sitting, Mrs Azinge’s lawyers disclosed that their client was absent due to ill health.
Responding, Justice Umar insisted that the CAC boss must appear in person.
He, therefore, ordered that the prosecution, defence and court registry, in the company of police, should go and make findings over Mrs Azinge’s health condition and report back to the court within two hours.
“Go and find out from the defendant’s health division, whether truly the defendant is sick or not and come back with a situational report for the court with evidences within 2 hours,” he stated.
According to Justice Umar, the evidence of Mrs Azinge’s health condition must be presented in pictorials.
DAILY NIGERIAN reports that the court adjourned its sitting for two hours, pending the return of the fact-finding delegation.
