Faith-based Non-Governmental Organization, Jama’atut Tajdidil Islamy Foundation, JTIF, on Monday, called for the institution of criminal proceedings against Sheikh Abduljabbar Kabara over alleged blasphemy.
The group filed a suit before the Kano State High Court seeking an Order of Mandamus compelling the Kano Commissioner of Police, and the state Attorney General.
Addressing Journalists in Kano shortly after filing the suit before Kano State Chief Judge, Justice Nura Sagir, counsel to the Applicant, Abubakar Tanko, said his client was seeking legal redress because the defendants failed to arrest, investigate and prosecute Kabara before the court for the alleged crime.
Mr Tanko alleged that Kabara, had on several occasions, been caught recording and making blasphemous statements against Prophet Muhammad (Peace be upon Him)
”A blasphemous statement against Prophet Muhammad contravenes several sections of the Kano State Shari’a Penal Code Law 2000.
”Abduljabbar conducts his preaching in an injurious manner to Islam and Muslims as a whole.
“We urge the court to compel the Kano Commissioner of Police, who is the Chief Law Enforcer of the State, and the Attorney General in his capacity as Chief Law Officer of the State to do the needful by arresting, investigating and prosecuting Kabara for what he allegedly committed against Prophet Muhammad”, Tanko said.
According to the counsel, the Applicant was also seeking the court to order the Attorney General to give a Fiat to his counsel for the prosecution of Abduljabbar Nasiru Kabara, for the alleged offence.
Recall that a Kano Chief Magistrates’ Court had on March 12, ordered the Kano Commissioner of Police, to also conduct investigations into alleged criminal defamation and threat to life against the Scholar.
