Alleged Certificate Forgery: Plateau Assembly lawmaker, begs court to dismiss case

Solomon Umoh (SAN), the counsel to the embattle former deputy speaker of the Plateau State House of Assembly, Ibrahim Baba Hassan, has urged the Jos division of the Federal High Court 2 to dismiss a suit of an alleged diploma certificate forgery against his client.

Mr Umoh made the urge while adopting his written address, during the Tuesday proceeding in Jos, saying: “The plaintiff said the defendant was not qualified to contest in the election but has not proven the disqualification of the defendant.”

The Counsel said he had wanted the University of Jos to be joined in the issue but the plaintiff refused.

According to him, when the UniJos Registrar was invited before the court, all he did was presenting letters but not academic records.

He added: “Your lordship, the court cannot decide on certificate, only the University can, and the registrar came here and told the court that the records are there in the University.”

Mr Umoh, therefore, urged the court to dismiss this case for lacking substance.

On his part, the Plaintiff Counsel, David Ibawuchi, briefly told the court that no matter how brilliant the address of Defence Counsel in written address could be, it might not be better off than the evidence before the court.

The APC Counsel, being the 2nd defendant, Ledak Dafer, said should the court remove away all averments about forgery, nothing new would be found that were not proved before the court.

“I urge the court to settle all issues raised in favour of the 2nd defendant,” Mr Dafer said.

The INEC Counsel, being the 3rd defendant, Fatima Narogo, told the court that they did not file a written address, urging the court to exercise it’s decision judiciously.

Justice Musa Kurya, therefore, adjourned the matter to 22 February for delivery of judgment.
