The Court of Appeal sitting in Abuja has reinstated the New Nigeria Peoples Party, NNPP lawmaker, Yusuf Umar-Datti, as the winner of the Kura/Madobi/Garun Malam Federal Constituency election.
The Kano State Election Petition Tribunal had sacked Mr Datti and returned Musa Kwankwaso of the All Progressives Congress, APC, as the winner of the election.
But the apellete court, in a judgement delivered on Monday by a three-man panel of justices led by Tunde Awotoye held that Mr Datti’s appeal had merit and allowed it.
The panel further contended that Section 77 of the Electoral Act was improperly applied because a political party’s membership is an internal matter over which a court has no jurisdiction, and that the tribunal erred in counting the date of the appellant’s resignation from the day of his party primaries.
