A Federal High Court sitting in Kano on Tuesday vacated its order restraining the chairman of Peoples Democratic Party, PDP in the state, Shehu Sagagi.
Mr Sagagi is allegedly loyal to a former governor of Kano State and presidential candidate of the New Nigeria Peoples Party, NNPP, Rabiu Kwankwaso.
On May 17, Justice A.M. Liman granted an order of interim injunction restraining the Sagagi-led executives of the PDP in Kano from exercising any power pending the hearing and determination of the Motion on Notice.
The case was filed by one Bello Bichi against INEC, PDP and 40 others.
Vacating the order on Tuesday, Justice Liman said the plaintiff, Bello Bichi, had misled the court into believing that there was urgency on the matter.
He further said that Mr Bichi lacks locus standi to file the case as he did not show proof that he is a member of the executive committee of the party.
Justice Liman therefore adjourned the case to May 26 for hearing of the substantive suit.
