A Kano High Court presided over by Justice A.T. Badamasi on Tuesday granted an order, stopping the Kano State governor Abdullahi Ganduje from taking over the powers of the kingmakers of Kano Emirate as contained in the Kano State Emirates Council Law, 2019.
The kingmakers, bearing titles of Madaki, Makama, Sarkin Dawaki Maituta and Sarkin Bai, had last week approached the court seeking an interim injunction restraining Mr Ganduje from taking away the traditional functions and powers of the kingmakers under the “purported Kano State Emirates Council Law 2019” pending the hearing of motion on notice.
The second interim order sought by the kingmakers was for the court to restrain Mr Ganduje from taking any steps or doing anything in any form whatsoever to remove, depose, transfer the Emir of Kano without due consultation with them.
While the judge refused to give the second interim order in view of the fact that the emir was not joined in the case, the court however granted the first order.
The order reads: “That an Order of Interim Injunction is hereby made restraining the 3rd Respondent [Mr Ganduje] from taking away the functions and powers of the Applicants under the Kano State Emirates Council Law, 2019 or taking any step whatsoever under the Law without consultation with the Applicants pending the hearing and determination of the motion on notice.”
The judge therefore adjourned the case to December 17 for hearing of the motion on notice.
DAILY NIGERIAN gathered that in the new emirate law passed and assented to last week, “the Governor shall in consultation with the Emirate Councils of Kano, Bichi, Karaye, Rano and Gaya Emirates apppoint Kingmakers for the Emirates.”
Background
The state governor, Abdullahi Ganduje, had on May 8 assented to the controversial law establishing four additional emirates with first class emirs in Bichi, Rano, Karaye and Gaya, which the state assembly passed within three days.
Following uproar over the creation of the emirates, the then Minority Leader of the House, Rabiu Gwarzo, filed a case challenging the legality of the procedure that led to the passage of the law.
On November 21, Justice Umar Na’abba of a Kano High Court delivered judgement in his favour, dissolving the emirates and sacking the emirs.
Apart from the foregoing case, there is another case instituted by Kano Emirate kingmakers pending before the same court that granted the interim order on Tuesday.
