The Federal High Court in Abuja on Wednesday nullified the election the Senator representing Kogi East Senatorial District, Attai Aidoko.
Mr Aidoko was elected on the platform of the opposition Peoples Democratic Party, PDP.
Delivering judgement, Justice Gabriel Kolawole ordered the clerk of the National Assembly to ensure the swearing in of Isaac Alfa, a retired air vice marshal to replace Aidoko.
The judge ordered that Mr Alfa, and not Mr Aidoko, was the winner of the PDP’s primary held in Idah on December 7, 2015.
He ruled that Mr Alfa was thus the rightful candidate of the PDP in the March 28, 2018 election conducted by the Independent National Electoral Commission.
Mr Kolawole ordered INEC to immediately withdraw the Certificate of Return issued to Mr Aidoko in 2015.
He also ordered the Clerk of the National Assembly to immediately withdraw the recognition and privileged being accorded Mr Aidoko as a senator.
According to the judge, Mr Aidoko’s nomination “was an exercise in futility to rob the plaintiff of the fruit of his election in the primary”.
The court therefore awarded a cost of N750,000 against Mr Aidoko and the PDP.
