A High Court sitting in Maiduguri on Wednesday sentenced a young man, Mohammed Goni, alias Hassan, to death by hanging for the murder of Musa Mohammed, a tricycle rider.
The court heard that Mr Goni conspired with his twin brother, Ibrahim Goni, alias Husseini, in 2014 to lure the victim to an uncompleted building at New GRA, Maiduguri, where they murdered him.
They then buried the corpse at the uncompleted building and took away his tricycle.
The crime was however busted when the tricycle was recovered from one Ajayi, who took the police to the twin brothers, from whom he bought the tricycle.
On further interrogation of the twin brothers, they took the police to the uncompleted building at New GRA where the body was exhumed.
However, the twin brother of the convict, Hussein, did not live to be part of the final judgement as he died in detention.
The trial judge, Fadawu Umar, before sentencing the accused, noted that the offence committed is a capital offence, contrary to section 221 of the penal code which is culpable homicide punishable with death.
He noted that in criminal trial, the burden of proof lies on the prosecution to prove that the accused caused the death of the deceased.
The judge added that in the case at hand, the prosecution established that the deceased died as a result of strangulation by the accused and that the body was exhumed eight days after the incident.
“I have no doubt that the offence of culpable homicide punishable with death has been committed. The accused is hereby convicted of the crime and is hereby sentenced to death by hanging,” the judge ruled.
