Despite Kano High Court judgement, deposed Emir Bayero holds court, attends functions

The deposed emir of Kano, Aminu Bayero, has continued to perform royal duties within and outside the Nassarawa royal residence in Kano, despite a court judgement perpetually restraining him from parading himself as emir.

The state High Court further issued a Form 48, which is a notice of consequence of disobedience of court order and liability to imprisonment, to Mr Bayero and the Inspector General of Police.

“TAKE NOTICE that unless you obey the directions contained in the order of the Honorable Court attached to this form, you will be guilty of Contempt of Court, and you will be liable to be committed to prison.

“TAKE FURTHER NOTICE that if the Respondents continue to disobey this order, you ALHAJI AMINU ADO BAYERO, who is in violation of this Honorable Court Order attached, will be held in Contempt of Court and be liable to imprisonment,” the Form 48 read.

DAILY NIGERIAN reports that on July 15, a Kano State High Court presided over by Justice Amina Aliyu, had perpetually restrained Mr Bayero and four other deposed Emirs of Bichi, Rano, Gaya and Karaye from parading themselves as emirs.

The judge further restrained the monarch and four other dethroned emirs by themselves, servants, privies and any other persons appointed by them from parading themselves as Emirs of Kano, Bichi, Gaya, Rano, Karaye.

She directed Mr Bayero and four other emirs to quickly hand over all the emirate traditional royal artefacts to the government and the reinstated Emir of Kano, Muhammadu Sanusi II.

While other deposed emirs complied with the judgement, DAILY NIGERIAN observed the emir has continued to live and hold court in the Nassarawa residence, calling the state government’s bluff to demolish the fence.

On Saturday, DAILY NIGERIAN gathered that the embattled monarch attended a Quranic graduation ceremony at Goron Dutse area, heightening tension over possible clash between his supporters and those of Emir Muhammadu Sanusi II.

Mr Bayero, who enjoys massive security protection in the residence since his deposition, was escorted by the police and supporters to the event.

When contacted for comment, Aminu Babba Dan’Agundi, a top courtier of the deposed monarch, said a Federal High Court in Kano, in its ruling on the case he filed, ordered that status quo ante be maintained.

According to him, the court’s ruling means Mr Bayero is the emir of Kano, not Mr Sanusi.

Mr Dan’Agundi, who holds the title of Sarkin Dawaki Babba, said since a court of coordinate jurisdiction had already passed its judgement on the matter, no any court of a similar ranking could overturn the decision.

“Aminu Ado Bayero will continue to engage in royal activities. He will continue to hold court, listen to the complaints and problems of his subjects at the palace. He will continue to attend functions when the need arises because we are acting on a court judgement that guaranteed him the right to do so.

“We are peace loving people. We always obey the law and respect order. The court said status quo ante should be maintained. This means Aminu is the emir, not Sanusi.

“It is Sanusi that should stop parading himself as emir because a judgement of Kano High Court cannot void that of the Federal Higher Court.

“This is judicial rascality because the state high court has no jurisdiction to void the order of the federal high court. The Federal High Court passed the judgement before the state High Court.

“Only the appeal court could void this ruling. Therefore based on the ruling of the Federal High Court, Aminu Ado Bayero is the emir and will continue to hold all royal and palace engagements,” he added.
