Emirship tussle: CJN summons Kano, Federal High Court chief judges over conflicting orders

The Chief Justice of Nigeria, CJN, Justice Olukayode Ariwoola, has summoned the Chief Judge of the Federal High Court, and the Chief Judge of Kano State over conflicting interim injunctions regarding the Kano Emirate.

The Channels TV quoted the CJN as giving the order on Wednesday in Abuja.

A Kano State High Court, presided by Justice Amina Adamu Aliyu, on Tuesday issued an order restricting the police and other security agencies from evicting or harassing the reinstated Emir of Kano, Muhammadu Sunusi II, and other kingmakers of the emirate.

The order also prevents any interference with the Emir’s autonomy and the seizure of key symbols of his authority, such as the twin-spear staff, the Royal Hat of Dabo, and the Ostrich-feathered shoes.

Moments after the state High Court order, the Federal High Court in the state, presided over by Justice S. A. Amobeda, issued a conflicting order for the eviction of Emir Muhammadu Sanusi II from the Kofar Kudu Palace, reinforcing the authority of the deposed emir, Aminu Bayero.

“An order of interim injunction restraining the respondents from inviting, arresting, detaining, threatening, intimidating, harassing the Applicant, or infringing on his rights is hereby granted,” stated Justice Amobeda.

He added that, “this order ensures that Emir Aminu Bayero enjoys all rights and privileges accrued to him by virtue of his position.”
