The Court of Appeal in Kaduna on Wednesday dismissed the appeal of a former Senior Special Assistant to the President on National Assembly Matters, Abdulrahman Kawu Sumaila, challenging the judgment of a Federal High Court in Kano that ordered Independent National Electoral Commission, INEC to issue Certificate of Return to Shamsudeen Dambazau.
Mr Dambazau is the son of a former minister of Interior Abdulrahman Dambazau.
In a unanimous decision, the court held that Mr Sumaila’s appeal lacked merit and consequently dismissed same without cost.
On October 23, Mr Shamsudden filed a suit at the Federal High Court in Kano challenging the election of Mr Sumaila, saying he was supposed to be nominated as the candidate of APC for Takai/Sumaila Federal Constituency.
The court, presided by Justice Lewis Alagoa, delivered judgement in Mr Shamsudeen’s favour.
Dissatisfied with the judgement, Mr Sumaila, APC and INEC therefore filed an appeal before the Court of Appeal in Kaduna.
