The suspended chairman of the Kano State Public Complaints and Anti-Corruption Commission, PCACC, Muhuyi Rimingado, has given reasons why he could not honour the invitation of the state House of Assembly.
The Kano State House of Assembly had invited Mr Rimingado to appear before its ad-hoc committee investigating a petition against him on Wednesday July 14, 2021.
Mr Rigingado, while citing health grounds, demanded a certified true copy of the petition the assembly received against him.
“Our brief indicates that the House of Assembly pursuant to its resolution of 5th July 2021 suspended our client and appointed your committee,” Mr Muhuyi’s lawyer, Usman Fari, wrote to the committee.
“Our brief further reveals that a letter with reference No. KNHA/CON/007 dated the 12th of July was dumped in our client’s residence while our client was away on medical appointment at National Hospital Abuja on the said 12th of July late in the evening.
“Copies of both the letter and medical records are herewith enclosed for ease of reference.
“Our client instruction to this eminent committee is to demand, and we hereby so demand the following.
“A Certified True Copy of the petition against our client.
“Certified True Copy/extract of the House resolution/proceedings of the 5th of July 2021 concerning the issue under reference.
“Certified true copy of the press releases dated the 5th and 7th July 2021 issued by the House of Assembly which form the basis of the news items clearly portraying our client as a sacked or removed chairman as restated in paragraph 2 line 2 of the letter dated 12th July to wit: “…investigating a complaint against you as the then Chairman…”
The lawyer therefore said his client’s request was borne out of his desire to answer and defend the allegations of the petitioner.
“The request is also in line with the basic principles of fair hearing and fair trial as enshrined in the Constitution of the Federal Republic of Nigeria which frowns at a trial by ambush.
“Consequent upon this, you may wish to avail our client with the documents requested.
“Our client is very willing and ready to honour your invitation, however you may wish to oblige our client adequate time in line with medical advice of his physicians,” the lawyer added.
